Terms of Service

Eligibility

FotoNest is provided by FotoNest Inc. and is intended for users 14 years and older.

Accounts

• You can sign up via Apple ID, phone number, or WeChat
• The same phone number serves as the merge anchor across all 3 login methods to a single account
• You are responsible for account security; do not transfer or share with others

Family groups and permissions

• Up to 6 members per family; the creator is the first album admin
• Each album can have 1-3 admins, who can be appointed or step down
• When the last admin leaves the family group, the album is auto-transferred to the earliest-joined member

Paid services

• Scanning is always free
• AI restoration is pay-per-photo, with first 5 deep restorations free for new users
• Payment via Apple In-App Purchase (StoreKit)

Refunds

• AI restoration: free re-generation within 24 hours for same SKU
• Restoration credits: unused portion refundable within 7 days

User content

• You retain all rights to photos you upload or scan
• You are responsible for copyright and portrait rights of scanned content
• FotoNest will never use your photos for training any model, and will not share them with third parties for their own purposes. We do share them with service providers acting under contract on our behalf: cloud infrastructure, and the content-safety service that reviews the photos and text you publish publicly.

Public content

You may publish a visit photo, a rating and a short review for a place. This is visible to all users, so the rules below apply.

• You keep ownership of what you publish, and grant us a non-exclusive licence to store, display and distribute it for operating the feature (for example, showing it under the place you reviewed, in every list that place appears in).
• You must hold the rights to what you publish — do not post other people's photos, or images of people who have not agreed.
• Do not publish content that is unlawful, obscene, violent, hateful, harassing, infringing, or that advertises or spams; do not post another person's private information.
• Photos are reviewed before they appear publicly. Reviews go live immediately and are reviewed afterwards.
• We may remove or hide content that breaks these rules, and may restrict or terminate accounts that repeatedly break them.
• Any logged-in user can report public content from the in-app report entry; we review reports and keep a record of each action taken.
• You can withdraw your own photo or review at any time from the place page.

Prohibited conduct

• Uploading content that violates applicable law
• Commercial exploitation without written authorization
• Malicious reverse engineering or service disruption

Service changes and termination

We may update features or adjust pricing; material changes are notified 30 days in advance. You may stop using the service and delete your account anytime.

Disclaimer

FotoNest is provided "as is". We do our best to maintain service availability, but are not liable for losses from force majeure (such as network outages) beyond the amount you actually paid.

Governing law

These terms are governed by the laws of the People's Republic of China. Disputes shall be resolved at a competent People's Court at the company's principal place of business (Dalian, China).
